Waste Management Licence Exemptions are Changing – Is Your Business Ready for EASR?

The way exempt waste activities are regulated in Scotland is changing.

As part of the implementation of the Environmental Authorisations (Scotland) Regulations (EASR), the existing system of Waste Management Licensing (WML) Exemptions is being replaced by a new environmental authorisation framework.

If your business currently relies on a waste exemption, now is the time to understand how these changes may affect you.

What is changing?

Historically, many businesses have operated under Waste Management Licensing Exemptions for activities such as waste storage, recycling, construction recovery and scrap metal recycling.

Under EASR, these exemptions are being replaced by new environmental authorisations administered by SEPA.

For operators holding Simple Waste Exemptions, the transition is particularly important, as existing exemptions will cease to apply from 1 November 2026. Operators will need the appropriate EASR authorisation in place before that date to continue operating.

For Complex Waste Exemptions, operators may need to apply for a replacement EASR authorisation before their exemption expires or by 1 November 2026, whichever comes first.

Who could be affected?

The changes affect a wide range of businesses, including:

  • Recycling facilities
  • Waste transfer stations
  • Construction and civil engineering companies
  • Manufacturers
  • Distribution centres
  • Retail businesses storing WEEE
  • Scrap metal recyclers
  • End-of-Life Vehicle (ELV) dismantlers
  • Land restoration contractors

Why review your exemption now?

Many exemptions were registered years ago and may not have been reviewed since.

Understanding your future authorisation requirements early allows you to:

  • identify the correct EASR authorisation;
  • understand any infrastructure requirements;
  • prepare supporting documentation;
  • avoid delays to future operations; and
  • maintain regulatory compliance.

How Albion Environmental can help

Albion Environmental is already helping businesses throughout Scotland prepare for the transition to EASR by:

  • Reviewing existing exemptions
  • Identifying the appropriate EASR authorisation
