Our client, J&R Scotland Ltd has successfully achieved regulatory approval from the Scottish Environment Protection Agency (SEPA) to use poultry litter ash (PLA) and sand from an incineration site as a construction aggregate.
The submission, made in August 2025, included compositional and leaching data that demonstrated the material is classified as non-hazardous waste and poses minimal environmental risk when managed under strict conditions. This evidence gave SEPA the confidence to allow the use of PLA without the need for further authorisation, provided it complies with defined controls.
Under the agreement, PLA and sand can now be used as a sub-base or fill material in road building, construction platforms, and beneath buildings, subject to restrictions and under specific containment measures.
The authorisation reflects SEPA’s recognition that PLA derived solely from poultry litter and meat and bonemeal incineration is suitable for reuse in construction. The move reflects increasing regulatory openness to alternative aggregates, provided robust evidence is supplied. For J&R Scotland, it marks a significant step in turning a by-product into a safe, commercially viable material for the built environment.
