The Waste Management Licensing (Amendment) Regulations (Northern Ireland) 2015

New regulations came into force in Northern Ireland on 17 August 2015. These Regulations form part of a number of changes to the 2003 (Northern Ireland) Regulations (as amended) and will enable the Northern Ireland Environment Agency opportunties to specify Technical Competence provision similar to that operating in England and Wales.

‘Table 1’ of the Regulations has been amended to incorporate Facility; Qualification and Unit revisions which reflect  the Facility types and Operator Competence Certificate requirements for the WAMITAB Level 4 qualifications i.e. those which comprise The ‘full’ qualification (usually 12 Units); ‘6 Units’ or ‘4 Unit’ clusters as appropriate. The Level 4 ‘Vocationally Related Qualification’, ‘Level 4 Certificate in Waste and Resource Management’ is also included within ‘Table 1’ for TCM provision in a similar way to that for England and Wales.

Please note that this change only affects the Technical Competence provision in Northern Ireland and the key points to note of the Northern Ireland 2015 Regulations are as follows:

  • A person holding an existing Certificate of Technical Competence shall be required to acquire a relevant up-to-date qualification as detailed in Schedule 1 within 24 months of the date of operation of these Regulations.
  • A person who has acquired technical competence must undertake an assessment every 24 months to ensure that that competence is kept up to date.
  • Anyone carrying out an activity listed in the Table [‘Table 1’] must obtain a relevant [WAMITAB] Operator Competence Certificate except where that activity is being carried out by way (virtue) of anexemption from waste management licensing. In the event of a person carrying out activities without the appropriate level of qualification, that person will not be deemed to be a fit and proper person, which may result in that person’s application being refused or their licence being revoked.
  • Where appropriate, the Department will recognise the [WAMITAB] Vocationally Related Qualification (VRQ) “Level 4 Certificate in Waste and Resource Management” as demonstrating operator competence where that certificate has been obtained as part of the WAMITAB Operator Competence Scheme.”
